Family-based Immigration Services
Rey can assist with a petition for permanent residency (green card) based on the following relationships to a U.S. Citizen or a Lawful Permanent Resident:
1. Immediate Relatives (no waiting list):
- Spouse of U. S. Citizens;
- Child under 21 of U.S. Citizens; and
- Parent of an adult U.S. Citizen
2. Preference Relatives - (waiting period dependent on availability of visas).
- 1st Preference: adult unmarried children of U. S. Citizens
- 2nd Preference: spouses and children of Permanent Residents; adult, unmarried children of Permanent Residents
- 3rd Preference: married children of U. S. Citizens
- 4th Preference: brothers and sisters of U. S. Citizens
3. Spouses and Children of Refugees or Asylees (no waiting list)
4. Battered Spouse and Children of U.S. Citizens or Permanent Residents
5. Fiancé of a U.S. Citizen
A fiancé K-1 nonimmigrant visa is also available for the foreign-citizen fiancé of a U.S. citizen. The K-1 visa permits the foreign-citizen fiancé to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival.
Employment-based Immigration Services
Nonimmigrant visa offerings include:
- O-1A: Individuals with an extraordinary ability in the sciences, education, business, or athletics;
- O-1B: Individuals with an extraordinary ability in the arts or extraordinary achievement in motion picture or television industry;
- O-2: Individuals who will accompany an O-1 artist or athlete to assist in a specific event or performance;
- O-3: Individuals who are the spouse or children of O-1 and O-2 visa holders;
- P-1A: Internationally Recognized Athlete;
- P-1B: Member of Internationally Recognized Entertainment Group;
- P-2: Performer or Group Performing under Reciprocal Exchange Program;
- P-3: Artist or Entertainer Part of a Culturally Unique Program;
Permanent residency (green card) can be petitioned for based on the following:
1. First Employment-Based Preference for "priority workers":
A. International Managers and executives transferred to work for a U.S. company;
B. Outstanding professors and researchers with universities or private employers that have established research departments; and
C. Persons of "extraordinary ability" in the sciences, arts, education, business, and athletics (no offer of employment required).
2. Second Employment-Based Preference
Persons of "exceptional ability" in the sciences, arts, or business and persons with advanced degrees or their equivalent. If the work performed is deemed in the National Interest and unique in nature, a labor certification may not be required.
3. Third Employment-Based Preference (labor certification and job offer required)
A. Professionals with bachelor's degrees not qualifying in the second preference;
B. Skilled workers (filling positions requiring at least two years of training and experience); and
C. Unskilled workers.
4. Fourth Employment-Based Preference
Religious Workers:
Person must have been a member of a religious denomination having a bona fide nonprofit, religious organization for two years immediately preceding application. Furthermore, the person must seek to enter the U.S. to carry on his/her vocation or religious occupation, and must have carried on such vocation or occupation for at least two years.
5. Fifth Employment-Based Preference
Employment Creation / Investors:
Requires investment of $1,000,000 or, depending on the circumstances, $500,000. Many strict requirements apply.
Naturalization
A lawful permanent resident who is 18 or older and meets continuous residence and physical presence requirements, good moral character requirements, and demonstrates knowledge of the English language, U.S. history, and government may apply to naturalize as a U.S. citizen.
